Please read these Terms and Conditions carefully before purchasing a membership. By accessing the SHARP platform or purchasing a subscription, you agree to be bound by these terms. If you do not agree, do not use the service. These terms constitute a legally binding agreement between you and SHARP.

About SHARP

SHARP is an Australian sports analysis and information service operated from Melbourne, Victoria, Australia. SHARP provides subscribers with AFL betting research, multi-bet card analysis, post-round review content, and related sports analysis (collectively, the "Content") through its online platform at sharp.com.au (the "Platform").

SHARP is not a licensed wagering service provider, bookmaker, or financial services provider. SHARP does not hold an Australian Financial Services Licence (AFSL) and does not provide financial advice, investment advice, or licensed gambling services as defined under the Gambling Regulation Act 2003 (Vic) or the Interactive Gambling Act 2001 (Cth). All Content is provided for informational and entertainment purposes only.

Important: SHARP analyses publicly available market information and sports data. SHARP does not operate a betting exchange, accept wagers, or handle gambling funds of any kind.

Acceptance of Terms

By accessing the Platform, creating an account, or purchasing a subscription, you confirm that you:

  • Are at least 18 years of age;
  • Have the legal capacity to enter into a binding agreement;
  • Are accessing the service from a jurisdiction where receiving sports analysis content is lawful;
  • Have read, understood, and agree to be bound by these Terms and Conditions in their entirety;
  • Agree to our Privacy Policy, which is incorporated into these Terms by reference.

If you are accessing SHARP on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.

Membership & Subscriptions
Subscription Tiers

SHARP offers the following subscription tiers, with pricing displayed on the Platform at the time of purchase:

  • Scout (Free): Limited access to sample content and post-round summaries. No payment required.
  • Member ($29/month): Full access to weekly multi cards for all AFL fixtures, Super Multi combinations, post-round bet reviews, injury intelligence, and season P&L tracker.
  • Sharp ($79/month): All Member inclusions, plus early card access, raw odds data exports, NRL coverage, private Discord access, and priority support.
Billing

Subscriptions are billed on a recurring monthly basis from the date of initial purchase, processed securely via Stripe. By subscribing, you authorise SHARP to charge your nominated payment method on each renewal date. You are responsible for ensuring your payment details remain current. Failed payments may result in immediate suspension of access.

Content Delivery

SHARP will use reasonable endeavours to deliver AFL multi cards prior to the first scheduled game of each round. Card publication is subject to the availability of relevant market data, team news, and injury information. SHARP does not guarantee delivery at a specific time and reserves the right to delay or withhold publication where data quality is insufficient to meet our research standards.

Personalisation & Watermarking

All Content delivered to your account is personalised with your member name and unique member identifier. This personalisation is applied to help us identify and act on unauthorised distribution of Content. By subscribing, you acknowledge that Content delivered to your account is uniquely identifiable and traceable to your account.

Refund & Cancellation Policy
Your Rights Under Australian Consumer Law

Nothing in these Terms limits, excludes, or modifies any rights you have under the Competition and Consumer Act 2010 (Cth), Schedule 2 ("Australian Consumer Law" or "ACL"). The ACL provides consumer guarantees that cannot be excluded by contract. If a service fails to meet a consumer guarantee, you may be entitled to a remedy including a refund, re-supply of the service, or compensation for reasonably foreseeable loss.

Digital Subscription Policy

Subject to your rights under the ACL, SHARP's policy on refunds for digital subscriptions is as follows:

  • Change of mind: SHARP is not required to provide refunds for change-of-mind cancellations. The ACL does not require change-of-mind refunds for services. If you cancel your subscription, access continues until the end of your current billing period and no partial refund is issued for unused days.
  • Access failure: If you are unable to access the Platform due to a technical fault on our end that we cannot resolve within 72 hours of being notified, you may request a pro-rata refund for the affected period.
  • Content not delivered: If SHARP fails to publish a round card for a complete AFL round with no reasonable notice or explanation, a pro-rata refund for that billing period will be considered upon written request.
  • Duplicate charges: If you are charged more than once for the same subscription period due to a billing error, we will promptly refund the duplicate amount.
No refunds are available in the following circumstances: dissatisfaction with betting outcomes following Content; disagreement with specific selections or analysis; change of mind after accessing Content for a round; failure to cancel prior to a renewal date; or account termination due to breach of these Terms.
How to Cancel

You may cancel your subscription at any time via your Account settings page or by contacting us at [email protected]. Cancellations take effect at the end of the current billing period. SHARP does not charge cancellation fees.

Refund Requests

To request a refund under the circumstances described above, contact [email protected] with your name, member ID, the nature of your request, and supporting details. We will respond within 5 business days.

Intellectual Property
Ownership

All Content on the SHARP Platform — including but not limited to multi cards, bet reviews, analytical methodology, written analysis, data visualisations, research processes, system design, software code, brand name, logo, and presentation format — is the exclusive intellectual property of SHARP and is protected under the Copyright Act 1968 (Cth) and applicable intellectual property laws.

Licence to Members

Upon purchasing a valid subscription, SHARP grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the Content solely for your own personal use. This licence does not permit you to:

  • Copy, reproduce, redistribute, screenshot-and-share, forward, or republish any Content to any person who is not a current paying SHARP member;
  • Use Content for commercial purposes, including reselling, repackaging, or incorporating it into your own tip service or product;
  • Create derivative works based on the Content;
  • Remove, obscure, or alter any watermarks, member identifiers, or proprietary notices on the Content;
  • Use automated systems, bots, or scrapers to access or extract Content from the Platform.
Enforcement

SHARP reserves the right to take legal action against any person who infringes its intellectual property rights, including seeking injunctive relief, damages, and an account of profits. All Content is watermarked and traceable to the originating member account. Evidence of unauthorised distribution will be used in any enforcement proceedings.

Sharing SHARP Content with non-members — including via screenshots, forwarded messages, group chats, or social media posts — constitutes copyright infringement and a breach of these Terms. It also results in immediate termination of your membership without refund.

User Conduct & Restrictions
Prohibited Conduct

As a condition of your membership, you agree not to:

  • Share account credentials — your login details are personal to you. Account sharing to allow multiple users to access a single subscription is prohibited;
  • Distribute Content — share, screenshot, forward, post, or otherwise distribute any SHARP Content to persons who are not current members;
  • Circumvent access controls — attempt to bypass authentication, access member-only areas without a valid subscription, or reverse-engineer the Platform;
  • Interfere with the Platform — upload malicious code, attempt denial-of-service attacks, or engage in any activity that disrupts Platform availability for other users;
  • Misrepresent affiliation — claim to be affiliated with, endorsed by, or acting on behalf of SHARP without express written authorisation;
  • Provide false information — create accounts using false identity or payment information;
  • Reproduce the methodology — use knowledge of SHARP's analytical approach, market research methodology, or product design to create a competing service.
One Account Per Person

Each subscription is for a single named individual. Multiple accounts held by the same person, or a single account used by multiple persons, will be terminated. SHARP may use device fingerprinting, IP monitoring, and session analysis to detect account sharing.

Reporting

If you become aware of unauthorised distribution of SHARP Content, please report it to [email protected]. SHARP takes intellectual property seriously and investigates all reports.

Nature of Content

SHARP provides sports analysis and research for informational and entertainment purposes only. Nothing published by SHARP constitutes financial advice, investment advice, or a recommendation to place any particular wager. All analysis reflects the opinion and research of SHARP at the time of publication and is subject to change without notice.

No Guarantee of Outcomes

Betting involves inherent risk and uncertainty. Past performance of SHARP selections is not indicative of future results. SHARP makes no representation, warranty, or guarantee that following its Content will result in profit or any particular outcome. Betting markets are subject to factors that cannot be predicted or controlled, including but not limited to player injury, late team changes, referee decisions, weather conditions, and market fluctuations.

You may lose money betting. Never bet money you cannot afford to lose. SHARP accepts no responsibility for financial loss of any kind arising from decisions made using its Content.
Limitation of Liability

To the maximum extent permitted by law (and subject to your non-excludable rights under the ACL), SHARP expressly disclaims all liability for:

  • Any financial loss, gambling loss, or consequential loss arising from use of or reliance on Content;
  • Any inaccuracy, error, or omission in the Content, including errors in published odds, player statistics, or injury information;
  • Delays in Content delivery or temporary Platform unavailability;
  • Any decision made by a user to place, not place, or modify a wager based on Content;
  • Loss of data or unauthorised access to your account resulting from your failure to maintain account security.
Cap on Liability

Where liability cannot be fully excluded under the ACL, SHARP's total aggregate liability to you for any claims arising under or in connection with these Terms is limited to the total subscription fees paid by you to SHARP in the three (3) months preceding the event giving rise to the claim.

Accuracy of Information

While SHARP takes reasonable care in preparing Content, we do not warrant that the Platform is free from errors. Odds, statistics, and injury information are time-sensitive and may change after publication. Members are responsible for verifying current market conditions before placing any wager. SHARP is not liable for odds movements or market changes occurring after Content is published.

Responsible Gambling

SHARP takes its obligations with respect to responsible gambling seriously. In accordance with the objectives of the Gambling Regulation Act 2003 (Vic) — which seeks to minimise harm caused by problem gambling and accommodate those who gamble without harming themselves or others — SHARP incorporates the following measures:

18+ Only

SHARP is strictly for persons aged 18 years and over. If you are under 18, you must not access, use, or subscribe to SHARP. By creating an account, you confirm you are 18 years of age or older. SHARP reserves the right to request proof of age at any time and to terminate accounts where the user is found to be underage.

Gambling Is Risky

Betting on sports involves financial risk. SHARP's Content is designed to inform decision-making, not to encourage excessive gambling. We strongly encourage all members to:

  • Set and adhere to a personal gambling budget;
  • Never bet money needed for essential expenses;
  • Take regular breaks from gambling activity;
  • Treat betting as entertainment, not a primary income strategy;
  • Be aware of the signs of problem gambling, including chasing losses, gambling beyond your means, or gambling affecting relationships.

BetStop is Australia's National Self-Exclusion Register. Registering with BetStop will prevent all licensed Australian wagering operators from accepting bets from you. Visit betstop.gov.au to register.
Our Commitment

SHARP will not market services in a manner designed to exploit vulnerable individuals, will include responsible gambling messaging in its Content, and will cooperate with any request from a member who wishes to self-exclude or limit their access for responsible gambling purposes. Termination of Access
Termination by You

You may cancel your subscription at any time via your Account settings or by contacting [email protected]. Cancellation takes effect at the end of the current billing period. You retain access to Content until that date. No refund is issued for the remaining unused period, consistent with the Refund Policy in Section 4.

Termination by SHARP

SHARP may suspend or permanently terminate your account immediately and without refund if you:

  • Share, distribute, or reproduce SHARP Content with non-members;
  • Share account credentials or allow others to access your account;
  • Breach any provision of these Terms;
  • Provide false or fraudulent information during registration or billing;
  • Engage in conduct that damages, disrupts, or brings SHARP into disrepute;
  • Attempt to circumvent the Platform's security or access controls;
  • Fail to pay subscription fees when due, including via failed payment.
Effect of Termination

Upon termination, your licence to access Content is immediately revoked. Any Content downloaded or saved prior to termination remains subject to these Terms — termination does not grant permission to retain or distribute previously accessed Content. SHARP reserves the right to pursue legal remedies for any breach that caused loss or damage, even after termination.

Survival

The following sections survive termination of your membership: Intellectual Property (Section 5), Disclaimer of Liability (Section 7), Governing Law (Section 10), and any accrued rights of SHARP in relation to breach.

Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria, and the Federal Court of Australia, to hear and determine any dispute arising out of or in connection with these Terms.

The following legislation applies to the relationship between SHARP and its members, among other laws:

  • Competition and Consumer Act 2010 (Cth) — including the Australian Consumer Law (Schedule 2)
  • Privacy Act 1988 (Cth) and the Australian Privacy Principles
  • Privacy and Data Protection Act 2014 (Vic)
  • Gambling Regulation Act 2003 (Vic)
  • Interactive Gambling Act 2001 (Cth)
  • Copyright Act 1968 (Cth)
  • Electronic Transactions Act 1999 (Cth)

Nothing in these Terms limits any rights you have under Australian law that cannot be excluded by contract. To the extent of any inconsistency between these Terms and any applicable law, that law prevails to the extent of the inconsistency.

Australian Consumer Law applies to all consumers in Australia regardless of what these Terms say. No clause in this document is intended to exclude or limit your statutory consumer rights.

Changes to These Terms

SHARP reserves the right to update or modify these Terms at any time. Where changes are material, we will provide not less than 14 days' notice to active members via email to the address registered to your account, or by prominent notice on the Platform. Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of those changes.

If you do not agree to the updated Terms, you must cancel your subscription prior to the effective date of the changes. A refund for the unused pro-rata portion of any prepaid subscription period will be offered where the changes materially diminish the service you subscribed for.
